§ 106.37. Beach Renourishment.

    Beach renourishment projects shall be subject to the standards pursuant to Fla. Stat. Chapter 161, Chapter 62b-36 F.A.C, Fla. Stat. § 370.12(1), Army Corps of Engineers, "CECW-EW Coastal Engineering Manual - Part V, July 31, 2003" and the Department of Environmental Protection: Office of Beaches and Coastal Systems, "Strategic Beach Management Plan, Florida Keys Region", 2000. The sand used for any renourishment project shall be sand which is similar to the native beach sand in both coloration and grain size and is free of construction debris, rocks, clay, or other foreign matter.

    B.

    Beach construction activities shall take place outside of sea turtle nesting season. During activities that require dredging, a qualified endangered species monitor shall be on station on the dredge at all times to ensure that no sea turtles or marine mammals are harmed by the project.
